Terms and Conditions for "Zahia" App
Introduction
Welcome to the "Zahia" App ("the App"). Please read these Terms and Conditions ("Terms") carefully before using the App. By using the App, you agree to comply with these Terms. If you do not agree to these Terms, please do not use the App.
1. Definitions
- "App": Refers to the "Zahia" application and its associated applications on Android and iOS platforms.
- "User": Refers to any person downloading and using the App to search for services provided by women's beauty salons and home service providers registered in the App.
- "Service Provider": Refers to women's beauty salons or home service providers registered in the App.
- "We/The Company": Refers to "Zahia" and any affiliated company managing the App.
- "Owner": Refers to the company owning the App.
- "Content": Includes texts, images, graphics, logos, icons, and software present in the App.
2. Acceptance of Terms
By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with any future modifications.
3. Changes to Terms
The App reserves the right to modify these Terms and Conditions at any time, and any changes to any of the Terms and Conditions will be posted on this page. Continuing to use the App after posting changes constitutes acceptance of the revised Terms and Conditions.
4. Registration and Account Creation
4.1 Account Creation:
Users must create an account using a valid Qatari mobile number and complete verification via an OTP (One-Time Password) sent via SMS.
4.2 Accurate Information:
Users agree to provide accurate and complete information during registration and must update it immediately upon any changes.
4.3 Account Protection:
Users are responsible for maintaining the confidentiality of their account information and must not share it with any third party.
5. Eligibility
Users acknowledge that they possess the legal eligibility according to applicable laws and are at least 18 years old. If a user is a minor, they acknowledge using the App under the supervision of a parent or legal guardian. Individuals lacking legal eligibility are prohibited from using the App.
6. Use of the App
6.1 Permitted Purpose:
The App is used solely for searching women's beauty salons and home service providers and booking appointments for available services.
6.2 Illegal Use:
The App must not be used for any illegal purposes or activities that conflict with public order or morals.
6.3 Compliance with Laws:
Users agree to comply with all applicable laws and regulations when using the App.
7. Services and Bookings
7.1 Description of Services:
The App provides a platform connecting users with service providers registered in the App.
7.2 Service Availability:
We strive to offer high-quality services but do not guarantee the availability or quality of services provided by service providers.
7.3 Booking Management:
Users can book, modify, or cancel appointments according to the terms set by service providers.
7.4 Booking Status:
Booking status is displayed in the App as follows:
- Pending: After a booking request is made and is awaiting review by the service provider.
- Confirmed: After the service provider approves the booking.
- Cancelled: When the user cancels the booking within the allowed period as defined by the service provider.
- Completed: After the successful completion of the service.
8. Payments and Billing
8.1 No In-App Payments for Users:
No payments are processed by users within the App.
8.2 Payment Methods:
Payments are made directly to the service provider after completing the service at the service location (salon or user’s home) using available payment methods outside the App such as cash, bank cards, or Apple Pay for Apple devices.
8.3 Refund Policy:
Refund processes are subject to cancellation procedures and policies specific to each service provider, which are clearly displayed during the booking process.
8.4 Payment Security:
Users: We are committed to protecting users' booking and transaction information through best security practices, despite not processing payments within the App.
8.4.1 Service Providers:
Payment Information: When using payment services, we may collect information related to your credit card details or bank account information.
Payment Protection: We protect your payment information using encryption, do not store sensitive data on our servers, and work with trusted payment services. We rely on two-factor authentication systems and continuous monitoring to detect any suspicious activity and protect your financial data.
9. Cancellation and Refunds
9.1 Cancellation:
Users can cancel bookings according to the cancellation terms specified by the service provider, which typically allow cancellation a certain period before the appointment time, with users unable to cancel on the day of the appointment.
9.2 Refunds:
Refunds are issued according to the cancellation and refund policies of each service provider.
9.3 Non-Responsibility:
"Zahia" is not responsible for any disputes arising from appointments, such as cancellations, non-payment, or refunds. Any such disputes must be resolved directly between the user and the service provider without involving "Zahia".
10. Reviews and Opinions
10.1 Writing Reviews:
Users can rate and provide their honest opinions about their experience after completing the service. "Zahia" does not guarantee the accuracy of reviews or ratings provided by other users, and users are solely responsible for relying on any of them.
10.2 Review Policy:
"Zahia" reserves the right to remove any reviews containing offensive language, inappropriate content, or misleading information.
10.3 Use of Reviews:
Reviews are used to improve service quality, assist service providers in enhancing their services, and enable other users to accurately evaluate available service options.
11. Privacy Policy and Data Protection
11.1 Privacy Policy:
We collect and use data from all users in accordance with the privacy policy adopted in the App, and users must adhere to it, which can be reviewed here.
11.2 Use of Data:
Data is used to enhance and develop app services and provide a personalized experience that aligns with user needs. We commit not to share data with any third party without explicit user consent, unless required by law.
12. Intellectual Property Rights
12.1 Intellectual Property Rights:
All rights related to the App and its content are reserved by the owning company, and copying, reusing, or transferring them partially or entirely without prior written permission from the owning company is prohibited.
12.2 Trademarks:
All trademarks and logos used in the App are the exclusive property of the owning company and cannot be used without obtaining a license from the trademark owner.
13. Disclaimer
13.1:
The App is provided "as is" and "as available" without any explicit or implied warranties, including but not limited to warranties of accuracy, efficiency, or suitability for the intended use.
13.2:
"Zahia" shall not be liable in any circumstances for any direct or indirect losses, or any material or moral damages alleged to result from the use or inability to use this App or the services provided by service providers. Users are fully responsible for their use of this App.
13.3:
"Zahia" is also not liable in any circumstances, including negligence, incidental or consequential damages resulting from data loss or profits, even if notified of the possibility.
14. Force Majeure
"Zahia" is not liable for any failure or delay in fulfilling its obligations under these terms and conditions due to events beyond its control, including natural disasters, wars, or labor disturbances.
15. Indemnification
Users agree to indemnify "Zahia" and the owning company against any claims, damages, losses, or expenses arising from their breach of these terms or their illegal use of the App.
16. Account Suspension or Termination
"Zahia" reserves the right to terminate or suspend user accounts at any time without prior notice if users violate these terms and conditions or for any other reason deemed appropriate.
17. Governing Law and Jurisdiction
These terms and conditions are governed by the laws of the State of Qatar, and the courts of Qatar have exclusive jurisdiction to adjudicate any disputes arising from these terms and conditions.
